3. General principles
3.1 Which data do we collect from you, and from whom do we receive this data?
First and foremost, we process personal data that you provide to us or that we collect when operating our website. In some cases, we may also receive personal data about you from third parties. This may include the following categories:
- Master data (name, address, date of birth, etc.);
- Contact data (mobile phone number, e-mail address, etc.);
- Financial data (e.g. account details);
- Online identifiers (e.g. cookie identifier, IP addresses);
- Location and traffic data;
- Audio and video recordings;
- data requiring special protection (e.g. biometric data or information about your health).
3.2 Under what conditions do we process your data?
We treat your data confidentially and in accordance with the purposes set out in this Privacy Policy. We ensure that processing is transparent and proportionate.
If, in exceptional cases, we are unable to comply with these principles, data processing may still be lawful if there is a legal basis. In particular, the following may constitute a legal basis:
- your consent;
- the performance of a contract or pre-contractual measures;
- our legitimate interests, provided your interests do not override them.
3.3 How can you withdraw your consent?
If you have given us consent to process your personal data for certain purposes, we will process your data within the scope of that consent, unless we have another legal basis.
You may withdraw your consent at any time by sending an e-mail to the address stated in the Legal Notice (Imprint). Processing activities that have already taken place are not affected.
3.4 In which cases can we disclose your data to third parties?
a. Principle
In some cases, we rely on the services of third parties or affiliated companies and may commission them to process your data (so-called processors). Categories of recipients may include:
- accounting, fiduciary and auditing firms;
- consulting firms (legal advice, taxes, etc.);
- IT service providers (web hosting, support, cloud services, website design, etc.);
- payment service providers;
- providers of tracking, conversion and advertising services.
We ensure that these third parties and our affiliated companies comply with data protection requirements and treat your personal data confidentially.
In some cases, we may also be obliged to disclose your personal data to authorities.
b. Visiting our social media channels
We may have included links to our social media channels on our website. This is visible to you (typically via corresponding icons). If you click on these icons, you will be redirected to our social media channels.
In this case, the social media providers will learn that you are accessing their platform from our website. The social media providers may use the data collected for their own purposes. Please note that we have no knowledge of the content of the transmitted data or how it is used by the operators.
c. Disclosure abroad
As part of processing activities, your personal data may be transferred to companies abroad. These companies are required to comply with data protection obligations to the same extent as we are. Transfers may take place worldwide.
If the level of data protection does not correspond to that of Switzerland, we carry out a prior risk assessment and ensure contractually that the same protection as in Switzerland is guaranteed (e.g. by using the new standard contractual clauses of the EU Commission or other legally required measures). If our risk assessment is negative, we take additional technical measures to protect your data. You can access the EU Commission’s standard contractual clauses via the following link. https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_de
3.5 How long do we retain your data?
We store personal data only for as long as necessary to fulfil the purposes for which the data was collected.
Data that we store when you visit our website is retained for twelve months. An exception applies to analytics and tracking data, which may be retained for longer.
We retain contract data for longer because we are required to do so by law. In particular, we must retain business communications, concluded contracts and accounting records for up to 10 years. If we no longer require such data from you to provide our services, the data will be blocked and used only for accounting and tax purposes.
3.6 How do we protect your data?
We will store your data securely and take all reasonable measures to protect your data from loss, access, misuse, or alteration.
Our contractual partners and employees who have access to your data are obliged to comply with applicable data protection regulations. In some cases, it may be necessary for us to forward your enquiries to affiliated companies. In such cases, your data will also be treated confidentially.
Within our website, we use the SSL procedure (Secure Socket Layer) in conjunction with the highest level of encryption supported by your browser.
3.7 What rights do you have?
a. Right of access
You may request information at any time about the data we have stored about you. Please send your request together with proof of identity to aarow@bluewin.ch.
You also have the right to receive your data in a commonly used file format if we process your data by automated means and if:
- you have given your consent for the processing of this data; or
- you have disclosed data in connection with the conclusion or performance of a contract.
We may restrict or refuse access or the release of data if this conflicts with our legal obligations, our legitimate private or public interests, or the interests of a third party.
The processing of your request is subject to the statutory processing period of 30 days. However, we may extend this period due to a high volume of requests, for legal or technical reasons, or because we require further information from you. You will be informed of the extension in due time at least in text form.
b. Deletion and correction
You may request the deletion or correction of your data at any time. We may reject the request if legal provisions require us to retain the data for a longer period or to keep it unchanged, or if a legal basis permits the continued processing.
Please note that exercising your rights may, in some cases, conflict with contractual agreements and may have consequences for the performance of the contract (e.g. early termination of the contract or cost implications).
c. Legal remedies
If you are affected by the processing of personal data, you have the right to enforce your rights in court or to file a complaint with the competent supervisory authority. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC): https://www.edoeb.admin.ch
3.8 Changes to this Privacy Policy
We may amend this Privacy Policy at any time. The changes will be published on aaron-j-wegmann.ch; you will not be informed separately.
4. Specific data processing activities
4.1 Providing the website and creating log files
What information do we receive and how do we use it?
When you visit aaron-j-wegmann.ch, certain data is automatically stored on our servers or on servers of services and products that we use and/or have installed, for system administration purposes, for statistical or backup purposes, or for tracking purposes. This includes:
- the name of your internet service provider;
- your IP address (in some cases);
- the version of your browser software;
- the operating system of the device used to access the URL;
- the date and time of access;
- the website from which you accessed the URL;
- the search terms you used to find the URL.
Why are we allowed to process this data?
This data cannot be attributed to a specific person, and it is not combined with other data sources. Log files are stored to ensure the functionality of the website and to safeguard the security of our IT systems. This constitutes our legitimate interest.
How can you prevent data collection?
The data is stored only for as long as required to achieve the purpose for which it was collected. Accordingly, the data is deleted after each session ends. The storage of log files is essential for operating the website; therefore, you have no possibility to object.
4.2 Google Ads
We use Google Ads on our website, an online advertising service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”). Google Ads enables us to place ads in Google search results and within the Google advertising network.
4.3 Google Ads Conversion Tracking
We use the online advertising program “Google Ads” and, as part of it, conversion tracking (visit action evaluation). Google Ads Conversion Tracking is an analytics service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”).
If you click on an ad placed by Google, a conversion tracking cookie will be stored on your device. These cookies have a limited validity, do not contain personal data, and therefore do not serve personal identification. If you visit certain pages on our website and the cookie has not yet expired, Google and we can recognise that you clicked on the ad and were redirected to that page.
The information collected using the conversion cookie is used to generate conversion statistics. We learn the total number of users who clicked on one of our ads and were redirected to a page tagged with a conversion tracking tag. However, we do not receive information that personally identifies users.
You can prevent the storage of cookies by selecting the appropriate technical settings in your browser software. Please note, however, that in this case you may not be able to use all functions of this website to their full extent. You will then not be included in the conversion tracking statistics.
You can also disable personalised advertising in Google’s ad settings. Instructions can be found at: https://support.google.com/My-Ad-Center-Help/answer/12155764.
4.4 MailChimp
We use MailChimp for sending newsletters and e-mail notifications. MailChimp is provided by The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.
If you subscribe to our newsletter, the data you provide and your e-mail address will be transmitted to, stored and processed by MailChimp. This enables us to send you regular updates, offers and information.
By subscribing to the newsletter, your IP address and the date of registration are stored. This storage serves solely as proof in the event that a third party misuses an e-mail address and subscribes to the newsletter without the authorisation of the entitled person.
MailChimp provides extensive analytics about how the newsletters sent are opened and used. These analyses are aggregated and are not used by us for individual evaluation.
The data stored by MailChimp will be deleted as soon as you unsubscribe from our newsletter. This does not affect data that we store for other purposes.
MailChimp has its own privacy policies and practices, which may differ from those of our website. For more information about MailChimp’s privacy practices, please visit: https://mailchimp.com/legal/privacy/. If you have questions about the data collected by MailChimp or wish to exercise your rights regarding this data, you should contact The Rocket Science Group, LLC directly.
4.5 Google Analytics
We use Google Analytics on our website, a web analytics service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Analytics uses so-called “cookies”, text files stored on your computer that enable an analysis of your use of the website.
The information generated by the cookie about your use of this website is usually transmitted to and stored on a Google server in the USA. If IP anonymisation is activated on this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area beforehand. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.
On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity and provide further services related to website and internet usage to the website operator.
The IP address transmitted by your browser within the scope of Google Analytics will not be merged with other data held by Google.
You can prevent the storage of cookies by adjusting your browser settings; however, please note that you may then not be able to use all functions of this website to their full extent. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser add-on available at the following link: https://tools.google.com/dlpage/gaoptout.
4.6 Google Tag Manager
We use Google Tag Manager to manage website tags via an interface. Google Tag Manager is a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Tag Manager itself (which implements the tags) is a cookie-less domain and does not process personal data. The service ensures that other tags are triggered, which may in turn collect data. Google Tag Manager does not access this data. If deactivation has been implemented at domain or cookie level, it will remain in place for all tracking tags implemented with Google Tag Manager.
By using Google Tag Manager, scripts (so-called tags) can be activated automatically on our website and data can be transmitted from your browser to Google. This data may include information about your IP address, the browser you use, the subpages you visit on our website and other interactions during your website visit.
4.7 Font Awesome
Font Awesome is operated by Fonticons, Inc., located at 6 Porter Road, Apartment 3R, Cambridge, MA 02140, USA. Font Awesome is a collection of scalable vector icons that allows website developers to integrate various icons and social logos on their websites.
We use Font Awesome to integrate visual icons on our website. This may include icons for user interfaces, social media links, or other graphical elements that improve the design and user experience of our website.
Font Awesome may load web fonts from the servers of Fonticons, Inc. when a user visits our website. In doing so, the user’s IP address is transmitted to Fonticons, Inc. This is necessary so that the user’s web browser can display the Font Awesome icons correctly.
Fonticons, Inc. stores users’ IP addresses only for a short period of time and solely for the purpose of providing the Font Awesome icons. No further storage or analysis takes place.
4.8 Google Fonts API
We use the Google Fonts API on our website, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”), to integrate fonts. By integrating these fonts, your browser will establish a connection to Google’s servers when you access our website in order to download and display the fonts correctly.
Through this connection, data—especially your IP address and information about the browser you use—may be transmitted to Google and stored on Google servers. These servers may be located in the USA or in other countries.
If you wish to prevent data transmission in connection with the Google Fonts API, you can block access to the domain fonts.googleapis.com in your browser settings. Please note that, in this case, our website may not be displayed correctly.
4.9 CookieYes
Our website uses CookieYes, a consent management service provided by CookieYes Limited to help us obtain and manage users’ consent for cookies and online tracking in accordance with legal requirements.
When you visit our website, CookieYes may collect information about your consent decisions and your interactions with the consent popup. This information is used to ensure that only the cookies and tracking technologies approved by you are activated on your device.
4.10 WordPress
Our website is based on the WordPress platform, a content management system developed by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. WordPress enables us to create, manage and publish content.
When using our website based on WordPress, various data, including your IP address, the date and time of access, and information about the browser you use, may be collected and stored. This data is primarily used for administrative purposes and to ensure the smooth operation of the website.
Some WordPress features, such as comments or contact forms, may collect additional personal data when you use them.
4.11 Google reCAPTCHA
To protect our website forms from unwanted requests, we use reCAPTCHA, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). The query serves to distinguish whether an input is made by a human or abusively by automated, machine processing. As part of the query, information such as your IP address or your behaviour when completing the form may be transmitted to Google.
For this purpose, your input is transmitted to Google and processed further there. By using reCAPTCHA, you agree that the recognition you provide is used to digitise old works. If IP anonymisation is activated on this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area beforehand.
Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser within the scope of reCAPTCHA will not be merged with other data held by Google.
BrainBox Generators
BrainBox Generators is a service provided by BrainBox Solutions GmbH to identify all data protection-relevant services on a website and, among other things, to assist in creating the Privacy Policy. No personal data is collected or processed in the process.
